Resumen
La presente investigación está enmarcada en el estudio del diagnóstico de las principales infracciones o violaciones sobre el uso de las marcas como signo distintivo de la Propiedad Industrial en el sector no estatal cubano, con especial referencia a las figuras del trabajador por cuenta propia y las cooperativas no agropecuarias, fundamentando así la necesidad de selección de una correcta estrategia marcaria que permita el establecimiento de una imagen corporativa y un nombre comercial propio. Para alcanzar los objetivos propuestos se emplearon métodos teóricos generales de las ciencias: histórico-lógico, análisis-síntesis, inducción-deducción; métodos específicos de las investigaciones jurídicas de orientación teórica: teórico-jurídico, jurídico-comparativo, exegético y el método empírico: análisis de contenido.

THE MARKS IN THE ECONOMIC ACTIVITIES NOT STATE IN VAT. MAIN INFRACTIONS
Abstract: The present investigation is framed in the study of the diagnosis of the main infractions or violations on the use of the marks like distinctive sign of the Industrial Property in the Cuban non state sector, with special reference to the worker's figures self-employed and the non agricultural cooperatives, basing the necessity of selection of a correct strategy would mark this way that it allows the establishment of a corporate image and an own commercial name. To reach the proposed objectives methods theoretical generals of the sciences they were used: historical-logical, analysis-synthesis, induction-deduction; specific methods of the juridical investigations of theoretical orientation: theoretical-juridical, juridical-comparative, exegetic and the empiric method: content analysis.
