AUTONOMÍA PRIVADA Y RÉGIMEN ECONÓMICO DEL MATRIMONIO. ¿UNA ALTERNATIVA DE REGULACIÓN EN CUBA?

Resumen: la presente investigación pretende fundamentar desde una visión histórica, doctrinal, comparada y legal, la necesidad de inclusión de un régimen legal de carácter supletorio en la normativa familiar cubana, admitiendo así la previsión de un régimen económico convencional, que posibilite dar un margen de actuación a la autonomía de la voluntad de los cónyuges en la ordenación de este, al permitir a cada matrimonio adecuar las reglas a su realidad. A fin de cumplimentar los objetivos propuestos se emplearon métodos generales de las investigaciones teóricas: histórico-lógico, análisis-síntesis e inducción-deducción; métodos específicos de las investigaciones jurídicas: teórico-jurídico, jurídico-comparativo y exegético; como método empírico: el análisis de contenido.

PRIVATE AUTONOMY AND ECONOMIC RÉGIME OF THE MARRIAGE. AN ALTERNATIVE OF REGULATION IN VAT?

Abstract: the present investigation seeks to base from a historical, doctrinal, compared and legal vision, the necessity of inclusion of a legal régime of supplementary character in the Cuban normative relative, admitting this way the forecast of a conventional economic régime that facilitates to give a performance margin to the autonomy of the will of the spouses in the ordination of the same one, when allowing to each marriage to adapt the rules to its reality. In order to execute the proposed objectives general methods of the theoretical investigations they were used: historical-logical, analysis-synthesis and induction-deduction; specific methods of the juridical investigations: theoretical-juridical, juridical-comparative and exegetic; as empiric method: the content analysis.
