UTILIZACIÓN DE LA PROSPECTIVA JURÍDICA PARA UNA MEJOR REGULACIÓN EN MATERIA DE AUTONOMÍA MUNICIPAL.

Resumen.

En un mundo globalizado y complejo, como el de hoy, se hace necesario que el Derecho conozca y utilice una herramienta vital para la construcción de sus normas: la prospectiva. Los cambios que se están produciendo en los diferentes ámbitos de la sociedad son tan importantes, tan profundos (y algunos de ellos, a un ritmo tal), que no son suficientes los análisis tradicionales que se alimentan desde y con datos exclusivos del pasado. Por ello se hace imprescindible disponer, además, de nuevas herramientas que permitan tener visiones de los posibles escenarios en cada uno de los ámbitos, y solo así podrán adoptarse las estrategias correctas para lograr el escenario deseado. Es este trabajo un acercamiento a la prospectiva como instrumento capaz de posibles evoluciones futuras a medio y largo plazo. Se definió como objetivo general: valorar las soluciones que pudiera aportar la prospectiva jurídica como instrumento, en pos de una mejor regulación en el ámbito municipal, y cómo su aplicación redundaría en beneficio para la sociedad, la toma de decisiones y el espacio público.

JURIDICAL UTILIZATION OF THE PROSPECTIVE FOR A BETTER REGULATION ON MUNICIPAL AUTONOMY.

Abstract.

In a globalized and complex world, like the of today, you have the feeling that necessary I know the right and utilize a vital tool for the construction of your standards: The prospective. The changes that are produced in the different spaces of the society are so important, so deep (and some their, to a rhythm such), that the traditional analyses that are fed are not sufficient from and with exclusive data of the past. To have, besides, new tools that they allow to have visions of the possible scenes in each one of the spaces becomes essential for it, and only that way they will be able to embrace the correct strategies to achieve the desired scene. This work is an approach to the prospective like capable instrument of possible future evolutions to half an and long term. He defined as general Objective: Appraising the solutions that the juridical prospective may contribute as I orchestrate, in pursuit of a better regulation in the municipal space, and how his application would result in benefit for the society, the overtaking and the public space.
