RESUMEN
El fenómeno de la religión viene siendo objeto de interés de forma creciente en las investigaciones jurídicas, específicamente en lo relativo a su regulación en los textos legales. Es este artículo un intento de adentrarse en las complejas posturas de los constituyentes de 1901 y 1940, en lo concerniente a los aspectos que se debatieron en torno al tema religioso, en el momento de la configuración de la Carta Magna que regiría la vida del país. No se limita a la mención del artículo final establecido, sino que hace referencia a los matices del debate, las posturas y actitudes asumidas por los constituyentes, que dieron lugar al precepto final establecido. Como resultado de lo anterior se definió como objetivo: determinar la continuidad o ruptura de la expresión del tema religioso en los debates constitucionales de 1901 y 1940, a través de las categorías invocación a Dios, separación Iglesia-Estado y libertad de culto.

THE RELIGIOUS THEME IN THE CONSTITUTIONAL REPUBLICAN DEBATE. 1901-1940.
ABSTRACT:
The phenomenon of religion, is being object of interest increasingly in the juridical investigations, specifically in it relative to his regulation in the codes of laws. This article is an attempt to go into the complex views of the constituent members of 1901 and 1940, with regard to the aspects that were debated about the religious theme, upon the configuration of the Magna Carta that the life of the country would govern. Is not limited to the mention of the established trailer record, rather reference makes of to the shades the debate, views and attitudes assumed by the constituent members, that they caused the final established precept. Was defined as objective as a result of the above: Determining the continuity or rupture of the expression of the religious theme in the constitutional debates of 1901 and 1940, through categories invocation to God, separation church and status, and freedom of cult.
