DESAFÍOS DE LA ANTROPOLOGÍA FORENSE Y SOCIAL EN LA IDENTIFICACIÓN HUMANA Y RESARCIMIENTO DE DERECHOS A LAS VÍCTIMAS DEL CONFLICTO ARMADO EN COLOMBIA

RESUMEN

El presente artículo de reflexión propone como finalidad plantear los desafíos de la antropología forense y social en materia de recuperación e identificación humana y el resarcimiento de derechos en un escenario de posconflicto en Colombia. En primer lugar, se hace una descripción importante de este tópico en un contexto de Derechos humanos, en segundo lugar, un análisis de las teorías que tienen una visión social y cultural en el marco de la justicia transicional y el aporte jurídico, finalmente, se presenta el aporte de la antropología forense y social a las familiares víctimas del conflicto interno ya en su etapa de posconflicto. Se concluye que, en un proceso integral de justicia, verdad, reparación y no repetición, no solo son importantes la recuperación e identificación de las víctimas, sino también, el descubrimiento del modus operandi de los victimarios, y servir testimonialmente en los procesos jurídicos de modo que, se aporte a las víctimas y a la memoria histórica.

CHALLENGES OF FORENSIC AND SOCIAL ANTHROPOLOGY IN HUMAN IDENTIFICATION AND REDRESS OF RIGHTS OF VICTIMS OF THE ARMED CONFLICT IN COLOMBIA

ABSTRACT

The purpose of this article is to present the challenges of forensic and social anthropology in the field of human recovery and identification and the redress of rights in a post-conflict scenario in Colombia. Firstly, an important description of this topic in a human rights context, secondly, an analysis of the theories that have a social and cultural vision in the framework of transitional justice and the legal contribution, and finally, the contribution of forensic and social anthropology to the victim's families of the internal conflict in its post-conflict stage. It is concluded that, before an integral process of justice, truth, reparation and non-repetition, it is not only the recovery and identification of the victims, but also the discovery of the modus operandi of the perpetrators, and to serve as testimony in the legal processes contributing to the victims and to the historical memory.

DESAFIOS DA ANTROPOLOGIA FORENSE E SOCIAL NA IDENTIFICAÇÃO HUMANA E NA REPARAÇÃO DOS DIREITOS ÀS VÍTIMAS DO CONFLITO ARMADO NA COLÔMBIA

RESUMO

O objetivo deste artigo é apresentar os desafios da antropologia forense e social no campo da recuperação e identificação humana e a reparação de direitos num cenário de pós-conflito na Colômbia. Em primeiro lugar, é feita uma importante descrição deste tópico no contexto dos direitos humanos, em segundo lugar, uma análise das teorias que têm uma visão social e cultural no âmbito da justiça transicional e da contribuição legal e, finalmente, é apresentada a contribuição da antropologia forense e social para as famílias das vítimas do conflito interno na de fase pós-conflito. Conclui-se que, num processo abrangente de justiça, verdade, reparação e não repetição, não só é importante recuperar e identificar as vítimas, mas também descobrir o modus operandi dos perpetradores, e servir como testemunha em processos judiciais de forma que contribua para as vítimas e para a memória histórica.
