RESUMEN

Este trabajo analiza el cambio en el sistema social desde la historiografía jurídica, a partir de la revisión del subsistema jurídico vigente en materia de violencia política en México y, para tal efecto, se emplea la metodología cualitativa. Se propone identificar el significado sociocultural que expresa ese contexto legal en cuanto a la protección que brinda a las mujeres y a los hombres, así como lo que eso dice de la idiosincrasia actual de esta sociedad. Así, el examen de la normatividad plantea la existencia de un fuerte movimiento histórico pendular relativo al género, que, en la actualidad, se muestra en la protección expresa solo para las mujeres en un campo sociopolítico y jurídico que hace 65 años, era exclusivamente masculino.

REFLECTING CULTURAL CHANGE IN THE MEXICAN LEGAL FRAMEWORK

ABSTRACT

This paper analyzes the change in the social system from the legal historiography, based on the review of the current legal subsystem on political violence in Mexico and, for this purpose, the qualitative methodology is used. It is proposed to identify the sociocultural meaning that this legal context expresses in terms of the protection it offers to women and men, as well as what that says about the current idiosyncrasy of this society. Thus, the examination of the normativity raises the existence of a strong historical pendulum movement related to gender, which, at present, is shown in the express protection only for women in a socio-political and legal field that 65 years ago was exclusively male.
